ORDINANCE NO. BL2008-208

An ordinance authorizing the Metropolitan Government to participate with Old South Properties, Inc., to provide public pressure sewer extension through construction of sewerage pump station and force main for its development at Old Hickory Pumping Station.

WHEREAS, Old South Properties, Inc., has expressed a desire to provide public pressure sewer extension through construction of a sewerage pump station and force main for its development at the Old Hickory Pump Station ; and

WHEREAS, Old South Properties, Inc., agrees to fund the additional operation and maintenance costs for the proposed pump station and force main in the amount of $70,000.00 at the time the Old Hickory Pumping Station , requests a sewer connection permit.

WHEREAS, NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The maintenance agreement with Old South Properties, Inc., to provide public pressure sewer through construction of a sewerage pump station and force main for its development at the Old Hickory Pump Station, attached hereto and incorporated herein, is hereby approved and the Director of Water and Sewerage Services is authorized to execute the same.

SECTION 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
