An ordinance to amend Chapter 16.24 of the Metropolitan Code to restrict the amount of fill material that can be placed upon property in close proximity to a river.
BE IT ENACTED BY THE METROPOLITAN COUNCIL OF NASHVILLE & DAVIDSON COUNTY:
Section 1. That Section 16.24.330 of the Metropolitan Code of Laws is hereby amended by adding the following new subsection S:
S. Fill material.
1. For purposes of this subsection, “fill material” includes, but is not limited to, rock, soil, and aggregate material.
2. No owner or occupant of any parcel of property shall cause or allow fill material in excess of 200 cubic yards per day to be placed upon the property if the property abuts a river or is within 500 linear feet of a river unless (a) the property is classified and permitted by the Tennessee Department of Environment and Conservation as a landfill; or (b) the Metropolitan Council approves fill in excess of 200 cubic yards upon adoption of a resolution. In order for the Metropolitan Council to approve such excess fill material, the Council shall, after consultation with Metro Water Services, make a finding on the record that the excess fill material will not pose a significant threat to water quality or aquatic life.
Section 2. This ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
