An ordinance approving an agreement between the Metropolitan Government and Capitol View Joint Venture concerning the construction of public park improvements and the donation of a parcel of property (Proposal No. 2018M-016PR-001).
WHEREAS, pursuant BL-2016-149 (the “CV Ordinance”), the Metropolitan Council approved a participation agreement addressing the construction of public infrastructure improvements to be completed in connection with the Capitol View development in downtown Nashville; and,
WHEREAS, as authorized by the CV Ordinance, Capitol View Joint Venture (“Capitol View”) donated to the Metropolitan Government an approximately 1.26-acre parcel of property to be used as a public park (the “Park Property”); and,
WHEREAS, the CV Ordinance contemplated that the Metropolitan Government would complete certain improvements (the “Initial Park Components”) to the Park Property to make it suitable for public use; and,
WHEREAS, the Metropolitan Council appropriated $2,500,000 for construction of the Initial Park Components; and,
WHEREAS, pursuant to the agreement (the “Agreement”) attached as Exhibit 1 to this Ordinance, Capitol View proposes to complete the Initial Park Components, as well as additional improvements, in exchange for a payment of $2,500,000; and,
WHEREAS, also pursuant to the Agreement, Capitol View proposes to donate an approximately 0.4-acre tract of real property to the Metropolitan Government; and,
WHEREAS, approval of the Agreement is in the best interest of the citizens of Davidson County.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Agreement is approved.
Section 2. The Director of the Department of Parks and Recreation and the Director of Public Property or their designees are further authorized to execute such documents as are customary and necessary to carry out the intent of this ordinance.
Section 3. Amendments to the Agreement may be approved by resolution of the Metropolitan Council.
Section 4. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
