An ordinance authorizing the acceptance or acquisition of easements by negotiation or condemnation for the purpose of construction, operation, maintenance, repair, replacement and inspection of a proposed streambank stabilization project along Whites Creek south of Old Hickory Boulevard (Proposal No. 2020M-051ES-001).
WHEREAS, the Metropolitan Government has received confirmation of funding from the Emergency Watershed Protection (EWP) program from the Natural Resource Conservation Service, a division of the United States Department of Agriculture, to survey, design and construct a streambank stabilization project along Whites Creek south of Old Hickory Boulevard; and,
WHEREAS, a 12 inch sanitary sewer main line parallels the creek along this section of the bank and is at risk of being compromised if erosion continues; and,
WHEREAS, completion of this project will remove a source of sediment loss into the creek; and,
WHEREAS, it is in the public interest that a temporary construction easement(s) be acquired for the construction, operation, maintenance, repair, replacement and inspection of a proposed streambank stabilization project; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2020M 051ES-001 on May 22, 2020, for the negotiation and acceptance of a temporary construction easement(s).
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept a temporary construction easement(s) for property located at 7158 Old Hickory Boulevard, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations and acceptance authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
