Resolution RS2019-1790

A resolution to request an amendment to Rule 8 of the Metropolitan Council Rules of Procedure.

WHEREAS, Rule 8 of the Metropolitan Council Rules of Procedure concerns the introduction of legislation, including the general provisions and limits on filing certain types of legislation; and

WHEREAS, Rule 8 also provides a district Council member the ability to defer by one meeting any resolution or ordinance on first reading, if that legislation affects only one district; and

WHEREAS, Metropolitan Government-owned properties larger than ten (10) acres, or which gross greater than $1.5 million per year in fees, should be exempted from this deferral provision within Rule 8; and

WHEREAS, larger parcels owned by the Metropolitan Government may reside only in one district, however, these are often the site of public spaces enjoyed by the entire county; and

WHEREAS, while these large parcels may exist in a single district, legislation introduced in regard to these parcels affect more than the district itself; and

WHEREAS, for these reasons, Rule 8 should be amended to exclude Metropolitan Government-owned parcels larger than ten (10) acres from the provision authorizing a district Councilmember to defer legislation by one meeting.

NOW, THEREFORE BE IT RESOLVED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY THAT:

Section 1. The Metropolitan County Council hereby goes on record as requesting an amendment to Rule 8 of the Metropolitan Council Rules of Procedure to exempt legislation regarding Metropolitan Government-owned parcels larger than ten (10) acres, or parcels which gross greater than $1.5 million in fees, from the provision allowing a district council member to defer for one meeting legislation affecting only that member’s district.

Section 2. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
