Vested Property Rights
In understanding property entitlements, it is important to recognize “vested property rights” in the land development process. "Vested rights" are claims enforceable under law and assist in defining reasonable expectations of property owners. In land use planning and development, the concept assists in fostering cooperation between the public and private sectors.
Resolution RS2014-1330 was passed by Metro Council in 2014 and establishes the requirements where landowners may exercise the rights established by the State of Tennessee’s Vested Property Rights Act of 2014.
Compact Development
The Compact Development proposal is currently scheduled for public hearing at the November 9, 2023 Metro Planning Commission meeting. If there are any changes to this schedule, Staff will provide updates to stakeholders and the public.
The Metro Planning Department is currently accepting public comment on a draft amendment to the Zoning Code to replace Lot averaging 17.12.080 with Compact Development.
The purpose and intent of Compact Development for unconstrained sites is focused on the encouragement of provision of diverse and flexible housing to meet current and future needs, and incorporation of recreational or usable open space appropriate to the scale and form of the development. To ensure consistency with NashvilleNext and community character policy goals, this tool is currently being structured to afford flexibility to sites zoned R/RS or R/RS-A, outside of T2 Rural policy areas.
The Metro Planning Department staff would like to thank everyone who attended our recent community meeting about the Compact Development proposal.
As mentioned in our meeting, attached is the PowerPoint presentation, case studies of the 6 different properties, and map associated with Compact Development.
