THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY

Subject: Communications Between Federal Immigration Authorities and the Metropolitan Government
I, John Cooper, Mayor of the Metropolitan Government of Nashville and Davidson County, by virtue of the power and authority vested in me, do hereby find, direct, and order the following:
- Reporting Policy: Pursuant to the recommendations contained in the Final Report of the Mayor’s Immigration Task Force delivered on December 13, 2019, all Covered Employees shall report certain Immigration Communications to the Designated Person at his or her Department/Office.
- Immigration Communications Subject to Reporting: The following communications (“Immigration Communications”) are subject to reporting in accordance with paragraph 3 below:
- Communications between federal immigration authorities and a Metro Department/Office pursuant to the Metro Department/Office’s policy or practice;
- Communications between federal immigration authorities and a Metro Department/Office related to modifying a policy or practice of the Metro Department/Office; and,
- Communications between known federal immigration authorities and the Metro Department/Office that are not pursuant to a policy or routine practice of the Department/Office.
- Timeline for Reporting/Responding:
- Communications between federal immigration authorities and a Metro Department/Office pursuant to the Metro Department/Office’s policy or practice shall be submitted on a monthly basis to the Mayor’s Office of New Americans at [email protected];
- Communications between federal immigration authorities and a Metro Department/Office related to modifying a policy or practice of the Metro Department/Office shall be submitted to the Mayor’s Office of New Americans at [email protected] with sufficient time for the Mayor’s Office to assess and respond to such proposed modifications, including seeking community input if appropriate, before the Metro Department/Office consents to the modification; and,
- Communications between known federal immigration authorities and the Metro Department/Office that are outside the policy or practice of the Metro Department/Office shall be reported to the Mayor’s Office of New Americans at [email protected] as soon as practicable, but in no case longer than three business days.
- Designated Person: Each Metro Department/Office shall designate one person who shall be responsible for collecting and transmitting Immigration Communications to the Mayor’s Office of New Americans in accordance with this Executive Order. The Mayor’s Office shall seek transparency by posting such reports that it receives pursuant to paragraph 3 above on the website for the Office of New Americans.
- Training Program: The Metropolitan Department of Human Resources, with the assistance of the Metropolitan Department of Law, and in connection with the Mayor’s Office of New Americans, shall develop a training program that includes information on the reporting of Immigration Communications pursuant to this Executive Order and shall assist each Metro Department/Office in providing the program to its Covered Employees.
- Covered Employees: This reporting and training directive shall apply to all employees of the Metropolitan Government who are reasonably likely to engage in Immigration Communications, except employees of the Nashville Electric Service, Metropolitan Nashville Airport Authority, Metropolitan Development and Housing Agency, Metropolitan Transit Authority, Metropolitan Sports Authority, Metropolitan Hospital Authority, the Board of Health, Metropolitan Nashville Public Schools, and elected officials. I hereby request that Nashville Electric Service, Metropolitan Nashville Airport Authority, Metropolitan Development and Housing Agency, Metropolitan Transit Authority, Metropolitan Sports Authority, Metropolitan Hospital Authority, the Board of Health, Metropolitan Nashville Public Schools, and elected officials develop a similar reporting and training program.
- Supervision Responsibility: Each employee of the Metropolitan Government who acts in a supervisory capacity is responsible for ensuring compliance with this Executive Order by those persons in his or her line of authority.
- Implementation of Training Program: Each Metro Department/Office shall ensure that Covered Employees receive the training required by this executive order on or before December 31, 2020, and at least once during each subsequent fiscal year. The director of each Metro Department/Office shall provide written certification to the Mayor’s Office of New Americans of compliance with this requirement, including a list of employees who received training.
