THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY

SUBJECT: Drug-Free Workplace Requirements
I, Karl Dean, Mayor of the Metropolitan Government of Nashville and Davidson County, by virtue of the power and authority vested in me, do hereby amend former Mayor Boner Executive Order No. 89-04 and find, direct and order the following:
I. Congress passed the Anti-Drug Abuse Act of 1988 to provide a drug-free workplace for all recipients of federal grants and contracts; and
II. The drug-free workplace objective remained in tact with each of the successive federal acts that followed after the repeal of the Anti-Drug Abuse Act of 1988; and
III. The Metropolitan Government maintains its responsibility, as required under 41 U.S.C.A. § 701 et seq., to have a policy statement to pursue and maintain the goal of a drug-free workplace.
Policy Statement: It is the policy of the Metropolitan Government of Nashville and Davidson County that:
1. The unlawful manufacture, distribution, dispensation, possession, or use of a controlled substance is prohibited in the workplace.
2. Any employee found to be in violation of provision No. 1 above shall be subject to disciplinary action that could include termination of employment.
3. The Employee Assistance Program is available to all employees of the Metropolitan Government. This program can aid employees in education as to the dangers of drug abuse and provide direction for drug counseling, treatment, and rehabilitation.
4. Each employee who performs work that is involved with a federal grant or federal contract will be given a copy of this statement.
5. As a condition of employment, those employees involved with a federal grant or federal contract must abide by the terms of this statement and must notify their appointing authority of any criminal drug statute conviction for a violation occurring in the workplace within five days after such conviction.
