THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY

SUBJECT: Accident Review Committee
I, Karl Dean, Mayor of the Metropolitan Government of Nashville and Davidson County, by virtue of the power and authority vested in me, do hereby find, direct and order the following:
I. Pursuant to Metropolitan Code of Laws 2.40.150, the Department of Law handles risk management for the Metropolitan Government.
II. It is in the best interest of the citizens of the Metropolitan Government for an advisory committee to assist in risk management by reviewing major accidents, providing departmental expertise, and making remedial measure recommendations to the Mayor and the Director of Law in order to reduce the likelihood that similar major accidents will occur.
III. There is hereby established a Major Accident Review Committee for the Metropolitan Government of Nashville and Davidson County.
IV. Definition
Major accident- An unexpected occurrence (e.g. a major automobile accident, or a large scale emission, fire, explosion, or other event) which results in the loss of life, extensive injury or illness, or where the loss of property or resulting damage to the environment is extensive.
V. Functions of the Accident Review Committee
1. It shall be the duty of the Accident Review Committee to investigate major accidents that occur within the operation of the Metropolitan Government, including major accidents involving contractor operations at Metropolitan Government construction sites or facilities or major accidents affecting visitors to Metropolitan Government facilities.
2. It shall be the duty of the Accident Review Committee to prepare, or cause to be prepared, Major Accident Prevention Reports in order to reduce the likelihood that similar major accidents will occur.
3. The Major Accident Prevention Reports are remedial in nature and shall:
a. Include the date, time, and place of major accidents occurring within the Metropolitan Government;
b. Include all damages, injuries, or loss of life resulting from the accident;
c. Include a brief description of the circumstances surrounding the major accident;
d. Identify the Departments involved in the preparation of the report;
e. Explain the cause of the major accident as determined by the Accident Review Committee;
f. Provide departmental procedure and policy recommendations to the Mayor designed to reduce the risk of having a similar major accident reoccur; and
g. Provide departmental procedure and policy recommendations to the Mayor designed to improve the level of protection for people, property, and the environment.
4. Major Accident Prevention Reports shall be completed within 90 days of a meeting of the Accident Review Committee and sent to the Mayor and the Director of Law.
VI. Membership
1. The following positions shall be permanent voting members of the Accident Review Committee:
a. The Director of General Services
b. The Director of Public Works
c. The Director of Finance
d. The Police Department Director
e. The Fire Department Director
f. The Director of Law
2. If not a permanent member, a Director of a Department that is one of the departments that has experienced a major accident being reviewed by the Accident Review Committee will be a non-voting member of the Committee for the review of that accident. If the Department of a permanent member is involved, that Director shall be a non-voting member for the purpose of the review of that accident.
3. All permanent members may select designees to appear and vote at meetings of the Accident Review Committee.
4. The members shall select a Chair from among themselves to serve as Chair for one year.
VII. Reporting Responsibility
It is the responsibility of Department Heads to report major accidents to the Director of Law for investigation by the Accident Review Committee. The Director of Law can also determine that an accident occurring within the Metropolitan Government qualifies as a major accident.
VIII. Meetings
1. The Accident Review Committee shall hold meetings as necessary to review major accidents in a timely manner. Such meetings may be called by the Mayor, the Director of Law, or the Chair. There shall be one regular meeting each year during the first week in January at which the Chair shall be selected for the current calendar year.
2. A quorum shall consist of five (5) voting members.
