THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY

SUBJECT: THE ESTABLISHMENT OF THE WORKFORCE INVESTMENT TASK FORCE
WHEREAS, the delivery of job training services is paramount to the prosperity and quality of the workforce of Metropolitan Nashville and Davidson County; and
WHEREAS, the job Training Partnership Act was enacted by Public Law 97-300 to establish federally funded programs to facilitate the delivery of job training services to economically disadvantaged adults and youth, and for individuals who have been dislocated from their jobs due to plant closure, mass layoff, or who are long term unemployed; and
WHEREAS, the Governor of the State of Tennessee has designated Metropolitan Nashville and Davidson County as a service delivery area for the expenditure of federal funds; and
WHEREAS, the Mayor's Employment and Training Resources Agency (METRA), operating through the Mayor's Office, is the agency through which the Metropolitan Nashville and Davidson County develops and administers the job training programs pursuant to the job Training Partnership Act; and
WHEREAS, the Metropolitan County Council adopted Ordinance No. 083-1335 approving the Memorandum of Understanding by and between The Metropolitan Government of Nashville and Davidson County and the Metropolitan Nashville/Davidson County Private Industry Council establishing an administrative partnership between the parties; and
WHEREAS, the Metropolitan Mayor as Chief Elected Official for Metropolitan Nashville and Davidson County Government has certain administrative responsibilities under the provisions of said Memorandum of Understanding by and between The Metropolitan Government of Nashville and Davidson County and the Metropolitan Nashville/ Davidson County Private Industry Council; and
WHEREAS, METRA needs guidance in day to day management and operation from experienced business; and
WHEREAS, the Congress of the United States has recently introduced legislation that would alter the delivery of job training services, significantly impacting the partnership of the parties and the preparation and quality of the future workforce of Metropolitan Nashville and Davidson County;
NOW THEREFORE, I, Philip Bredesen, Mayor of The Metropolitan Government of Nashville and Davidson County, by virtue of the power and authority vested in me, do hereby direct and order the following:
That there be created and established the Workforce Investment Task Force (WITF) for the purposes contained herein. Members of the WITF shall serve at the pleasure of the Mayor for such term as the Mayor may designate. The WITF shall be responsible for overseeing the administration and management of the Mayor's Employment and Training Resources Agency (METRA) including, but not limited to, recommending, for approval by the Mayor, staff salaries, personnel policies, and benefit levels within the limits of available administrative funds; providing guidance and direction to the management personnel of METRA in the day to day management and operation of METRA, including the financial affairs of METRA to ensure the prudent and lawful utilization of agency resources; and performing other oversight responsibilities as directed by the Mayor.
The WITF shall recommend for appointment by the Mayor an Executive Director, who shall be responsible for the day to day administration of METRA.
The WITT shall have such members as designated and determined appropriate by the Mayor, including, but not limited to, members of the Executive Committee of the Metropolitan Nashville Private Industry Council; and
The WITF shall prepare and submit to the Metropolitan County Council and the Mayor such reports on the facilitation of job training services, including but not limited to, the number of citizens served, amounts of federal funds received and expended, and a projection of the scope and nature of expected future services. These reports shall be produced and submitted in such intervals as deemed necessary and reasonable by the Mayor.
The WITY shall recommend bylaws, which shall be submitted to the Office of the Mayor for approval, within 60 days from the date of this Order. The Metropolitan Nashville Private Industry Council shall be given the opportunity to review and comment on such bylaws prior to submission.
Neither this Order nor the WITF shall supersede, change or otherwise diminish the responsibilities of The Metropolitan Nashville/Davidson County Private Industry Council as such responsibilities are stipulated in the job Training Partnership Act UTPA), as amended, or so agreed upon in the Memorandum of Understanding by and between The Metropolitan Government of Nashville and Davidson County and the Metropolitan Nashville/ Davidson County Private Industry Council. The Metropolitan Nashville/Davidson County Private Industry Council shall continue to perform such responsibilities as have normally and customarily been carried out by such party without regard to the provisions of this Order.
Anything to the contrary notwithstanding, the Mayor specifically retains and does not delegate the right and obligation to appoint members to the Private Industry Council (PIC), as established under Section 102 of the job Training Partnership Act, as amended. If the provisions of any statute or regulation conflict with this Order, then the provisions of this Order that conflict shall be superseded, and all other provisions of this Order shall remain in full force.
The WITF shall undertake the responsibility vested in it by the powers of this Order on or before the seventh day of November, 1995.
