Permit applicants for affected projects would demonstrate compliance with construction and demolition material requirements through the existing Debris Management Review in the building permitting process for building permit issuance and use and occupancy (U&O) approval. Permit applicants would submit a waste management plan identifying the types of materials to be generated on the project and what facilities those materials will be hauled to for recovery or disposal before a permit can be issued. A waste management report for U&O approval would include material quantities and all weight tickets. Both the plan and report would be reviewed to ensure compliance with the proposed requirements.
Exceptions for complying with the schedule of materials would be provided where C&D wastes are hazardous, especially those that contain asbestos or lead-based constituents or are generated during disaster emergency situations where disaster debris needs to be removed quickly.
Projects that are found non-compliant will be provided guidance and education to bring their waste management plan into compliance prior to building permit issuance. Projects that remain non-compliant could be subject to civil infractions.
